The following elected officials were present: M. Cheberenchick; N. Kovach; J. O’Malley; G. Orr; V. Smith; R. Zezulewicz; D. Baumgarten. Council Member M. Warhold and Tax Collector S. Torris were absent. The following appointed officials were present: D. Biondo, Solicitor; K. Truver, Police Chief; T. Hartswick, Borough Manager, P. Vietmeier, Codes Official; Junior Councilperson M. Yanda.

The minutes of the January 10, 2011 council meeting were presented. Ms. O’Malley motioned to approve the minutes; Mr. Cheberenchick seconded; all in favor; motion carried.

Mr. Zezulewicz officially opened the public comment section of the meeting. Mr. Zezulewicz noted the dedication of Mr. and Mrs. Tim Kelly of Connor Road in attending the borough meetings. No comments were received. The public comment section was closed.

Bid Openings:
Nothing to report.

Public Hearings:
Nothing to Report.

Civil Service Commission:
Nothing to report.

Real Estate Tax Collectors Report:
Ms. Kovach made a motion to exonerate the tax collector of the delinquent real estate taxes for the year 2010 totaling $80,353.98 with penalties and interest; Mr. Cheberenchick seconded; all in favor; motion carried.

Mayor Baumgarten stated that Mike McCabe will schedule a visit with borough council members and the borough manager in February to discuss the liened tax collection process. Mr. Biondo added that each liened tax property must be reviewed on a case by case basis due to payment plans, formal agreements, litigation, etc.

Council Committee Reports

Building and Grounds:
Mr. Orr presented two asphalt sealing quotes for the borough building parking lots: Kernan Asphalt Sealing Inc. - $5,576; and Aloisio’s Asphalt Maintenance - $6,557. Ms. Kovach motioned to contract with Kernan Asphalt Sealing Inc.; Ms. O’Malley seconded; all in favor; motion carried. The work will be coordinated with Public Works crack sealing of the parking lots before sealing.

Planning and Codes:
Mr. Veitmeier has been reminding local residents to keep their sidewalks clear of snow.

The zoning hearing board awarded a variance for the medical center at 345 Mt. Lebanon Boulevard.

Ladds Sterling has indicated his willingness to return this spring to accept the position of codes assistance.

Public Safety:
Chief Truver described two burglaries on McRoberts Road. Many other local communities have reported the burglaries with the same method of operation. Additional information is available on the borough website.

Chief Truver and Ms. Munson will visit Allegheny County’s 911 center to review their computer-aided dispatch software.

Public Works:
Ms. Kovach reported that many good comments have been received regarding public works department’s winter road maintenance.

Editorial Board:
Ms. Miller contacted the IN Keystone Oaks magazine regarding advertising costs. Information will be forthcoming.

Mayor Baumgarten reported a $230,000 loss for 2010. The ambulance service is seeking legislation to require health plans to pay ambulance fees directly to the ambulance company, instead of to the patient.

Municipal Associations:

Allegheny County Boroughs Association:
Nothing to report.

Allegheny League of Municipalities:
Nothing to report.

South Hills Area Council of Governments:
Ms. O’Malley and Ms. Kovach received correspondence regarding the RAD distribution for 2009 and 2010.

Police Pension:
Nothing to report.

Junior Council Person:
Ms. Yanda reported that mid-term exams were conducted last week. The wrestling team has won all five matches. Girls’ basketball is 10 and 5. Boys’ basketball is 10 and 7.

Earned Income Tax Collector's Report:
Nothing to report.

Engineer's Report:
Mr. Zezulewicz stated that council needs to review options for building an enclosure over the front entrance and walkway due to leakages in the police department.

Manager's Report:
Mr. Hartswick presented Borough Resolution 558 to participate in the energy conservation measure retrofit phase of Allegheny County’s energy program. Ms. O’Malley motioned to adopt Resolution 558; Ms. Kovach seconded; all in favor; motion carried.

Mayor Baumgarten announced that Judge Michael Marmo will speak at the January Mayor’s Association Dinner regarding a plan he uses in giving community service as part of sentencing for probation of both juveniles and adults.

Mayor Baumgarten reported that the Connect board is seeking solicitors to participate in a committee to develop intergovernmental agreements. Ms. Miller added that the committee will be seeking dues to retain participation in Connect.

Planning Commission Report:
Nothing to report.

Solicitor's Report:
Mr. Biondo discussed a potential rezoning along Sleepy Hollow Road. The ordinance has been drafted, and needs to be reviewed by the county planning department and the borough’s planning commission. Two properties will be rezoned from R2 to C1.

Mr. Biondo described a court case involving code violations that Mr. Vietmeier was working on. The borough was successful and won both court cases over a $50 fine. The defendant appealed to the commonwealth court.

Keystone Oaks:
Nothing to report.

Zoning Hearing Board:
Nothing to report.

Mr. Orr commended Ms. Miller and the administrative staff for doing a fine job during Mr. Hartswick’s medical absence.
