CASTLE SHANNON BOROUGH
MINUTES OF REGULAR MEETING
February 23, 2009

The following elected officials were present: R. Carlucci; M. Cheberenchick; J. O'Malley; M. Warhold; R. Zezulewicz; D. Baumgarten. Council members P. Coffey and N. Kovach and Tax Collector S. Torris were absent. The following appointed officials were present: T. Hartswick, Manager; D. Biondo, Solicitor; H. Lane, Police Chief. Codes Official P. Vietmeier was absent

The minutes of the February 9, 2009 council meeting were presented. Mr. Cheberenchick motioned to approve the minutes; Mr. Carlucci seconded; all in favor; motion carried.

Mr. Zezulewicz officially opened the public comment section of the meeting.

George Orr, 791 Killarney Drive - suggested installing two hour parking signs on sections of Killarney Drive and Blossom Hill. Chief Lane and Mayor Baumgarten will make parking recommendations to borough council at the next meeting.

Mr. Zezulewicz closed the public comment section.

Mr. Zezulewicz asked Kevin Brett and Jason Stanton of Lennon, Smith, Souleret Engineering to present the Engineer's Report.

Engineer's Report: Mr. Stanton stated that field and utility surveys have been completed and the concept plan and design has been prepared for the Grove Road Bridge. Three options were presented, and the pre-cast arch bridge with a wider right-of-way was the most cost effective. The wider right-of-way would necessitate acquiring footage on land designated with a historical landmark building. A lengthy discussion continued on the right-of-way acquisition for the proposed bridge. Mr. Hartswick and Mr. Stanton will contact the property owners to discuss the possible acquisition, and Mr. Hartswick will review the grant documentation for stipulations. A discussion continued on the existence of a mine in the area and the mine grouting costs which necessitates a geotechnical investigation. Ms. O'Malley motioned to authorize the appropriate officials to enter into an agreement with the geotechnical engineering firm of Ackenheil Engineers Inc. for the Grove Road Bridge project; Mr. Carlucci seconded; all in favor; motion carried.

Mr. Stanton discussed the Administrative Consent Order and Consent Order Agreement and presented the Interim Progress Report No. 5 for the sanitary sewer system. Mr. Stanton added that the borough is ahead of schedule for the federally mandated program. Mr. Zezulewicz stated it was extremely doubtful that the borough would be receiving assistance from the federal stimulus package to help with funding the bridge, sewer repairs or road programs.

Mr. Stanton presented the schedule and estimates of probable cost for the Hamilton Park tennis court resurfacing project and library roof replacement project. The tennis court project will not commence until after the Memorial Day weekend to accommodate the Community Day event.

The potential 2009 roadway improvement program listing for Castle Shannon was presented to council. Mr. Hartswick will review the list and make a recommendation of streets to be paved for council's next meeting. Mr. Cheberenchick and Mr. Baumgarten discussed the exorbitant cost of brick road replacement versus paving costs.

Civil Service Commission:
The agenda contained the Civil Service Review for 2008.

Real Estate Tax Collectors Report:
Mr. Hartswick presented Resolution 543 to extend the payment dates for real estate taxes due to a delay in receiving information from Allegheny County. Mr. Carlucci motioned to adopt Resolution 543; Mr. Cheberenchick seconded; all in favor; motion carried.

Council Committee Reports:

Building and Grounds:
Mr. Warhold discussed the bands that will be performing for Community Day 2009. Advertising and booth rental information will be mailed to borough businesses.

The borough codes enforcement officer has been aggressively pursuing some downtown businesses to bring their properties up to code.

Evol Memoirs had their grand opening over the weekend. The business provides services as a wedding planner, provides floral arrangements, and custom bridal wear.

Editorial Board:
Mr. Zezulewicz asked council to begin preparations for the spring newsletter.

MRTSA:
Mayor Baumgarten reported that Castle Shannon had the fastest emergency response time for January 2009.

Municipal Associations:

Allegheny County Boroughs Association:
Nothing to report.

Allegheny League of Municipalities:
Nothing to report.

South Hills Area Council of Governments:
Ms. O'Malley presented Mr. Hartswick with contacts for Pennsylvania American Water and discussed the borough's procedure to notify utility companies prior to road paving projects.

Police Pension:
The agenda contained 2008 annual investment report.

Earned Income Tax Collector's Report:
Nothing to report.

Manager's Report:
Nothing to report.

Mayor:
Chief Lane discussed complaints received about parking on Baldwin Street. Many residents are not utilizing their driveways and parking on the street. Residents without driveways will be issued parking permits, and two hour parking limits will be set. Ms. O'Malley motioned to place parking restrictions as stated on Baldwin Street on a temporary basis; Mr. Cheberenchick seconded; all in favor; motion carried.

Mr. Carlucci motioned to authorize the appropriate officials to advertise an ordinance to amend the parking ordinance; Ms. O'Malley seconded; all in favor; motion carried.

Planning Commission Report:
Nothing to report.

Solicitor's Report:
Nothing to report.

Keystone Oaks:
Mr. Warhold discussed the shareholder's meeting held at Myrtle Avenue Elementary School. Residents' discussed the school's strengths and weaknesses and test scores along with declining enrollment. Kimball Architects will be providing a survey in the future.

Zoning Hearing Board:
Nothing to report.

Other:
Ms. O'Malley discussed the fact that The Almanac will be discontinuing newspaper delivery to the borough and suggested that Mr. Hartswick write a letter on behalf of borough council to the Almanac about their elimination of Castle Shannon news and service.
