The following elected officials were present: R. Carlucci; M. Cheberenchick; N. Kovach; J. O'Malley; R. Zezulewicz; D. Baumgarten; S. Torris. Council Members P. Coffey and M. Warhold were absent. The following appointed officials were present: D. Biondo, Solicitor; T. Hartswick, Manager; K. Truver, Police Chief; P. Vietmeier, Codes Official; and Kristie Munson, Junior Council Person.

The minutes of the September 28, 2009 council meeting were presented. Ms. Kovach motioned to approve the minutes; Ms. O'Malley seconded; all in favor; motion carried.

Mr. Zezulewicz officially opened the public comment section of the meeting. Being none, Mr. Zezulewicz officially closed the public comment section of the meeting.

Bid Openings:
Mr. Hartswick presented the SHACOG bid tabulation report for the winter road materials joint purchasing. Mr. Carlucci motioned to accept the bids; Ms. O'Malley seconded; all in favor; motion carried.

Mr. Hartswick presented one bid for a surplus 1991 GMC bucket truck for $578.00. Ms Kovach motioned to accept the bid; Mr. Carlucci seconded; all in favor; motion carried.

Public Hearings:
Nothing to report.

Civil Service Commission:
Nothing to report.

Real Estate Tax Collectors Report:
Ms. Torris reported September collections of $5,695.90. Balance to be collected is $129,266.48. Collections are at 95% - the same as the prior year.

Ms. Torris attended a seminar regarding tax collection to maintain her qualifications as a certified tax collector.

Council Committee Reports:

Building and Grounds:
Mr. Hartswick reported on a meeting with Chuck Means, Attorney for Goehring, Rutter & Boem, regarding delinquent tax collections, condemnation proceedings and demolition funding.

Planning and Codes:
Mr. Vietmeier reported Mark's Willow Inn is reopening.

Two hearings are scheduled this week at the magistrate's office for non-compliance with the borough's occupancy inspection ordinance. One building is an unsafe structure. The police department has assisted the codes department in identifying junk cars for removal.

Mr. Vietmeier commended the police department for their speed enforcement efforts on Canal Street.

Public Safety:
The agenda contained the September monthly reports.

Chief Truver discussed possible signage for Canal Street due to the high volume of speeding traffic. Installing signage to limit turns during high traffic peak hours would increase the traffic on Willow Avenue. Maintaining directed patrols will continue. Mayor Baumgarten suggested that the borough should limit traffic on Canal Street to residents only.

Chief Truver and Mayor Baumgarten checked signage on Willow Avenue at Chestnut Street. Additional signage would not be beneficial. Officers have been enforcing speed limits and stop sign violations.

The police department's monthly message discussed speed control and requested that residents contact the police department regarding their concerns.

Ms. Kovach stated she would like to review signage on Castle Shannon Boulevard and Willow Avenue regarding the no left hand turn signs. Mayor Baumgarten advised that Castle Shannon Boulevard is a Penndot road. Signage recommendations will be made to council.

Public Works:
Nothing to report.

Editorial Board:
Mr. Zezulewicz stated the newsletter is on target and the drafts are being prepared.

Municipal Associations:

Allegheny County Boroughs Association:
Nothing to report.

Allegheny League of Municipalities:
Nothing to report.

South Hills Area Council of Governments:
Nothing to report.

Police Pension:
Nothing to report.

Junior Council Person:
Ms. Munson reported that the evaluation for the consolidation elementary schools has cost $25,000. New board members will be elected in December, and they will make a decision on the options before the end of the 2009-2010 school year.

Earned Income Tax Collector's Report:
Distribution Analysis: EIT - $24,116.81; LST - $3,224.33.

Engineer's Report:
Nothing to report.

Manager's Report:
Mr. Hartswick presented Resolution 549 to participate in a free energy audit for the municipal center. Ms. O'Malley motioned to adopt Resolution 549; Mr. Cheberenchick seconded; all in favor; motion carried.

Mayor Baumgarten commended Mr. Vietmeier on doing a great job for our community with the code enforcement issues in the borough. Council agreed.

Planning Commission Report:
Nothing to report.

Solicitor's Report:
Mr. Biondo requested authorization for the appropriate borough officials to enter into an agreement for former Police Chief Lane's retirement. Mr. Carlucci made the motion; Ms. O'Malley seconded; all in favor; motion carried.

Keystone Oaks:
Nothing to report.

Zoning Hearing Board:
Mr. Vietmeier reported that a legal notice was advertised for a billboard by Genesis Inc. The hearing was cancelled. The case will be challenged regarding the validity of the ordinance at a later date.
