The following elected officials were present: K. Brannon, M. Cheberenchick, N. Kovach; J. O’Malley; M. Randazzo; D. Swisher; M. Warhold; D. Baumgarten; S. Torris. The following appointed officials were present: T Hartswick, Borough Manager; K. Truver, Police Chief; D. Biondo, Solicitor; K. Kocelko, Junior Council Member; P. Vietmeier, Codes Official. K. Simms Strnisa of Simms Strnisa Court Reporting was present to record the public hearing section of the meeting.

The minutes of the November 9, 2015 council meeting were presented. Ms. O’Malley motioned to approve the minutes; Ms. Randazzo Seconded; all in favor; motion carried.

Prior to the start of the meeting, Ms. Kovach recognized Ms. O’Malley and Mr. Cheberenchick and Mayor Baumgarten read proclamations from Senator Wayne Fontana’s office for their many years of service on council and their tireless work to help make our community a better place to live. Also attending and reading proclamations regarding their achievements were Jen from State Representative Dan Miller’s office and Congressman Tim Murphy.

Mayor Baumgarten listed the various committees that Mr. Cheberenchick and Ms. O’Malley were members of, and added that he was honored to be a part of their lives both on council and as treasured friends.

Mayor Baumgarten proclaimed November 23, 2015 as Mike Cheberenchick Day and November 24, 2015 as Jean O’Malley Day.

Ms. O’Malley and Mr. Cheberenchick thanked their families and everyone who supported them over their years as public servants. Bid Openings:

Public Hearings:
Dustin Jones was present at the council meeting to request a conditional use for his new business, Mindful Brewing Company on the site of the former McGinnis Brothers on Route 88. Mr. Warhold questioned Mr. Jones on aspects of his business such as store hours on weekdays and weekends. Also being proactive against driving under the influence, Mr. Jones will have a Uber Station on site where you connect with a driver for a ride to your destination.

Mr. Warhold motioned to approve a conditional use application for Mindful Brewing Company subject to the following conditions: Applicant will comply with all requirements as presented by the borough engineers and borough ordinance code. Applicant will record the shared easement agreement once it is reviewed by the borough. Applicant must receive a variance approval for shared parking spaces and approval from PENNDOT for the proposed landscaping in their right of way. Mr. Swisher seconded the motion; all in favor; motion carried.

Chief Truver explained in depth the definition of “discharge of firearms”. Mr. Swisher questioned whether Castle Shannon had any hunting areas. Chief Truver said there is not a designated area, but the borough cannot supersede state game laws. On private property, if the owner meets the specified setbacks and gives their authorization, hunting could be permitted.

Ordinance #902 was presented prohibiting the discharge of firearms, bow and arrow and similar devices and providing penalties for violations. Ms. O’Malley motioned to approve Ordinance #902; Ms. Randazzo seconded; all in favor; motion carried.
