The following elected officials were present: R. Carlucci; M. Cheberenchick; P. Coffey; N. Kovach; J. O'Malley; R. Zezulewicz; D. Baumgarten. Council Member M. Warhold and Tax Collector S. Torris were absent. The following appointed officials were present: T. Hartswick, Manager; D. Biondo, Solicitor; H. Lane, Police Chief and P. Vietmeier, Codes Official.

The minutes of the November 10, 2008 council meeting were presented. Ms. O'Malley motioned to approve the minutes; Mr. Cheberenchick seconded; all in favor; motion carried.

Mr. Zezulewicz temporarily turned the meeting over to Mayor Baumgarten.

Mayor Baumgarten invited Lieutenant Michael Cheberenchick and Officer Tom Yonek to the meeting to commend them for the professionalism and alertness in their actions that saved the life of a suicidal resident. Lt. Cheberenchick stated that due to a great sense of timing on God's part, he and Officer Yonek were able to save the resident's life, and the prognosis is good for a full recovery. Officer Yonek added that Lt. Cheberenchick was very calm and professional and deserves the credit for saving the resident's life. Council agrees that the community is very proud of these officers and our police department.

Mr. Zezulewicz opened the public comment section of the meeting.

George Orr, 791 Killarney Drive - has concerns about the timing in salting and plowing Killarney Drive due to school bus traffic. Mr. Zezulewicz and Mr. Coffey stated that the major arteries and hills must be maintained first. The police department determines when the road crew is called out, and the routes are determined for public safety. The borough manager will discuss this concern with the public works foreman.

Mr. Zezulewicz closed the public comment section of the meeting.

Bid Openings:
Mr. Hartswick presented the 2008/2009 Winter Road Materials bid opening through SHACOG. Mr. Coffey motioned to accept the bids; Mr. Carlucci seconded; all in favor; motion carried.

Public Hearings:
Nothing to report.

Civil Service Commission:
Nothing to report.

Real Estate Tax Collectors Report:
Mr. Zezulewicz noted a decrease of $836,100 for Family Video in the value change report from the Allegheny County Office of Property Assessments, and asked Mr. Hartswick to review this change with Ms. Torris for clarification.

Council Committee Reports:

Building and Grounds:
Nothing to report.

Mr. Cheberenchick motioned to ratify the October's treasurer's report; Ms. Kovach seconded; all in favor; motion carried.

Mr. Hartswick presented the proposed budget for 2009 with the following millages: General Fund - 5.62 mills; Debt Service - 1.466 mills; Street Lighting - .300 mills and Library - .514 mills. The budget does not include a tax increase; however the budget was balanced by transferring $206,637 from the capital fund and utilizing a portion of the fund balance forward. Mr. Hartswick and Mr. Zezulewicz agree that 2010 will be a challenging budget year with a possible tax increase. Mr. Zezulewicz stressed that Castle Shannon Borough is very conscious of our costs, and taxes have not been raised in several years. Final budget adoption is scheduled for December 8th.

Ms. O'Malley stated that two applications have been received for two openings on the library board. Application deadline is December 1st.

Planning and Codes:
Mr. Vietmeier noted a USA convenience store has opened on Route 88. BIU will assist in following up with the business owner to comply with borough regulations.

A Mexican restaurant plans to relocate from Hillcrest Shopping Center to Lebanon Shops in January.

Mr. Vietmeier noted that the City of Pittsburgh is contacting landlords regarding occupancy permits, and Castle Shannon is in the forefront and began this procedure months ago.

Public Safety:

Public Works:
Nothing to report.

Editorial Board:
Mr. Zezulewicz stated that the newsletters are being labeled and will be mailed this week.

Municipal Associations:

Allegheny County Boroughs Association:
Nothing to report.

Allegheny League of Municipalities:
Nothing to report.

South Hills Area Council of Governments:
Ms. O'Malley stated that some municipalities have not signed their contract with Allied Waste, and the contract must be signed to be valid.

Police Pension:
Mr. Cheberenchick noted that third quarter profits are down.

Earned Income Tax Collector's Report:
Nothing to report.

Engineer's Report:
Nothing to report.

Manager's Report:
Mr. Hartswick presented Resolution 538 revising rates for sewage service and discussed the ACO activities undertaken by the borough. Council discussed the expensive unfunded federal mandate to remove storm water and groundwater infiltration from the sanitary sewer lines. Mr. Zezulewicz noted that the Castle Shannon's sewage rate is less than other neighboring communities in the South Hills. Mr. Cheberenchick motioned to adopt Resolution 538; Mr. Carlucci seconded; all in favor; motion carried.

Mayor Baumgarten warns residents to beware of phising. This fraud occurs when criminals use computers to lure people in divulging personal information in order to supposedly inherit money.
