The following elected officials were present: K. Brannon; M. Cheberenchick; N. Kovach; J. O’Malley; D. Swisher; M. Warhold; D. Baumgarten. Council Member V. Smith and Tax Collector Shirley Torris were absent. The following appointed officials were present: T. Hartswick, Borough Manager; Police Chief K. Truver; P. Vietmeier, Codes Official; D. Biondo, Solicitor; M. Kunig, Jr. Council Person.

The minutes of the November 26, 2012 council meeting were presented. Ms. O’Malley motioned to approve the minutes; Mr. Warhold seconded; all in favor; motion carried.

Ms. Kovach opened the public comment section of the meeting.

Kathy Cox, 944 Scott Way – had parking concerns for her visitors. Permit zones were designated to deter commuter parking for the trolley in residential areas. Council agreed to issue guest passes to Ms. Cox for the permit parking zone.

Ms. Kovach closed the public comment section.

Bid Openings:
Nothing to report.

Public Hearings:
Russell McKibben, Act 32 Representative for Castle Shannon, addressed council on Jordan Tax Services earned income tax collections. Collections are substantially higher than last year, and there have been no appeals filed. Discussion continued on out of county and out of state collection procedures. Council thanked Mr. McKibben for his assistance to the community and for serving on this board.

Civil Service Commission:
Nothing to report.

Real Estate Tax Collectors Report:
The agenda contained the November report. November collections were $6,405.05. Balance to be collected is $119,829.68.

Council Committee Reports

Public Relations/Communications:
Nothing to report.

Public Works/Building and Grounds:
Nothing to report.

Public Safety/Fire:
The agenda contained the November reports.

Mr. Hartswick presented the tentative 2013 all fund budgets. No tax increase is proposed. Castle Shannon is still waiting for the 2013 assessed valuation report from the county. Mr. Cheberenchick motioned to approve the tentative 2013 budget for advertising with the understanding that the actual mileage will be set after the county’s valuation report is received. Ms. O’Malley seconded; all in favor; motion carried.

Mayor Baumgarten advised that changes to the assessed valuation may continue into next year due to the number of assessment appeals that have been filed. Mr. Biondo stated that the deadline to pass the 2013 budget may be extended to January upon Judge Wettick’s ruling, and a significant number of commercial appeals are pending for 2013.

Ms. Brannon motioned to ratify the November treasurer’s report; Ms. O’Malley seconded; all in favor; motion carried.

Community Activities/Planning & Codes:
Mr. Warhold reported that the revitalization corporation will be meeting on Wednesday evening, and preparations will begin for the 2013 Community Day.

Mr. Vietmeier will be unavailable for the next few weeks, and Ladds Sterling, Assistant Codes Officer, will be filling in as needed.

Ms. Kunig reported that the boys’ basketball team won the tournament this weekend.

Engineer's Report:
Mr. Swisher motioned to approve the 2013 engineer’s agreement with Lennon, Smith, Souleret Engineering Inc.; Ms. O’Malley seconded; all in favor; motion carried.

Manager's Report:
Nothing to report.

Mayor's Report:
Nothing to report.

Planning Commission:
Final approval of the site and building plan for Tri-State Flooring was tabled.

Demolition is being completed on Arch Avenue.

Solicitor's Report:
Nothing to report.

Keystone Oaks:
Nothing to report.

Zoning Hearing Board:
Nothing to report.

Mr. Warhold spoke with Kevin Brett of Lennon, Smith, Souleret Engineering Inc. who advised that the cost for the comprehensive road program may be less than originally estimated. Mr. Brett made favorable comments on the condition of the borough parks.
