The following elected officials were present: R. Carlucci; M. Cheberenchick; N. Kovach; J. O'Malley; M. Warhold; R. Zezulewicz; D. Baumgarten; S. Torris. Council member P. Coffey was absent. The following appointed officials were present: D. Biondo, Solicitor; T. Hartswick, Manager; K. Truver, Police Chief; and Kristie Munson, Junior Council Person. Codes Official P. Vietmeier was absent.

The minutes of the November 23, 2009 council meeting were presented. Ms. O'Malley motioned to approve the minutes; Mr. Cheberenchick seconded; all in favor; motion carried.

Mr. Zezulewicz officially opened the public comment section of the meeting.

Al Lowe, Reporter for the Pittsburgh Post Gazette - stated that it was nice to be back in Castle Shannon.

Mr. Zezulewicz officially closed the public section of the meeting.

Bid Openings:
Mr. Hartswick reported on the SHACOG re-bid for the Grove Road Bridge Replacement held on December 10, 2009. Grant funding of $425,000 from DCED and $180,000 from CDBG are expected. C.H.& D. had the successful low base bid of $942,349 with add alternates of $32,983.50 for a total of $975,332.50.

Mayor Baumgarten stated that borough officials have tried to work with Penndot for over twenty-five years to repair the bridge. Many communications and meetings were held with state and county legislators on this project over the years. Mr. Zezulewicz added that the proposed financing is finally in place, and the timing will coincide with the Route 88 Penndot project. The project time line will be from January 4, 2010 to July 2, 2010.

Mr. Warhold motioned to award the bid of $975,332.50 to C.H.&D.; Ms. O'Malley seconded; all in favor; motion carried.

Mayor Baumgarten added that grant funding for the project was obtained because of the increased number of jobs dependent upon MARSA's continued development which is possible due to the heavier weight limitations on the new bridge design.

Public Hearings:
Mr. Hartswick presented Tax Levy Ordinance 871. Mr. Zezulewicz noted that the budget does not include a tax increase. Mr. Zezulewicz opened the public hearing on the ordinance. No comments were received; therefore Mr. Zezulewicz closed the public hearing.

Mr. Hartswick presented the proposed budget for 2010 with the following millages: General Fund - 5.62 mills; Debt Service - 1.466 mills; Street Lighting - .300 mills and Library - .514 mills. Mr. Carlucci motioned to adopt the 2010 budget; Ms. Kovach seconded; all in favor; motion carried.

Ms. O'Malley motioned to adopt Ordinance 871 at its first reading. Mr. Cheberenchick seconded; all in favor; motion carried.

Civil Service Commission:
Nothing to report.

Real Estate Tax Collectors Report:
Ms. Torris reported November collections of $9,473.43 with a remaining balance due of $116,265.05. Collections are at 95%, which is $21,000 behind the collections in 2008 due to a significant reduction from the St. Vincent DePaul property.

Council Committee Reports:

Building and Grounds:
Mr. Warhold reported on the first community day meeting for the 2010 event.

Mr. Hartswick, Mr. Vietmeier and Mr. Warhold will attend a Sustainable Pittsburgh seminar on fighting blight.

Mr. Cheberenchick motioned to ratify the November treasurer's report; Ms. Kovach seconded; all in favor; motion carried.

Ms. O'Malley reported that the Santa breakfast was a huge success, and the children had a wonderful time.

Planning and Codes:
Ms. Kovach commended Mr. Vietmeier on his job in resolving code violations in the borough.

Public Safety:
Chief Truver noted that almost every week there are vehicle accidents on Library Road in the construction zone. Information has been posted on the website to reduce speed and turn headlights on in construction zones.

Public Works:

South Hills Area Council of Governments:
Ms. O'Malley reported that December will be her last meeting as president of the board of directors. Mr. Zezulewicz thanked Ms. O'Malley for representing Castle Shannon.

Police Pension:
Nothing to report.

Junior Council Person:
Ms. Munson thanked council for inviting her to the borough Christmas party.

Keystone Oaks elected Raeann Lindsey as a new board member from Castle Shannon.

A community blood drive is scheduled for the high school from 8:00 a.m. to 2:00 p.m. on Friday, December 18th.

Earned Income Tax Collector's Report:
November Distribution Analysis: EIT - $71,869.29; OPT - $13,572.12.

Engineer's Report:
Nothing to report.

Manager's Report:
Mr. Hartswick presented the Lennon, Smith, Souleret Engineering Inc. agreement for 2010. Ms. Kovach motioned to authorize the appropriate officials to enter into the agreement; Ms. O'Malley seconded; all in favor; motion carried.

Mr. Hartswick discussed Act 44 with Ron Bittner of Trollinger Consulting Inc. and Chelsa Wagner's office. Act 44 stated a pension plan could not make a contribution to an individual politician. Trollinger Consulting Inc. does make a contribution to the borough's community day. Act 44 does not apply since the contribution is not made to a specific political candidate.

Mayor Baumgarten stated that the Shannon Station project is still moving forward. Tax increment financing will be requested from the borough, school district and county. The tax break is necessary for the contractor to get supplemental funding for the parking deck.

Mayor Baumgarten discussed having the pleasure of serving with Bob Carlucci and Paul Coffey since they were elected to the Castle Shannon Borough Council. Mr. Carlucci and Mr. Coffey are fine gentlemen who dedicated their time and talents to the borough for many years, and they will be missed. All of council agreed. Mr. Warhold added that Mr. Carlucci's expertise in the matters of delinquent taxes, sheriff sales and public safety has been a real asset to the community.

Mayor Baumgarten also voiced a welcome to the newly elected council members, Vince Smith and George Orr.

The agenda contained the legislative meeting agenda of 12/9/09.

Zoning Hearing Board:
Nothing to report.

Mr. Cheberenchick noted an e-mail from Dianne Kowalski regarding a lack of attendance at the Veteran's Day ceremony at Myrtle Avenue Elementary School. Council discussed the e-mail. Any notification from borough should be coordinated through Jim Cromie, Communications Specialist for Keystone Oaks.
