CASTLE SHANNON BOROUGH
MINUTES OF REGULAR MEETING
December 15, 2003

The following elected officials were present: R. Carlucci; M. Cheberenchick; P. Coffey; N. Kovach; J O'Malley; D. Baumgarten; S. Torris. Council Member T. Kirk, Council President R. Zezulewicz and Tax Collector S. Torris were absent. The following appointed officials were present: T. Hartswick, Manager; D. Biondo, Solicitor; H. Lane, Police Chief.

The minutes of the December 8, 2003 council meeting were presented. Ms. O'Malley motioned to approve the minutes; Mr. Carlucci seconded; all in favor; motion carried.

Mr. Coffey called for public comments or requests.

Mr. Stanley Karas, Jr., 3112 May Street - Discussed historical photos he will be donating to the borough and recommended the public works department review temperature changes during winter due to water freezing and causing icy edges on the roadways.

Mr. Coffey officially closed the public comment portion of the meeting.

Bid Openings: Nothing to report.

Public Hearings: Nothing to report.

Civil Service Commission: Nothing to report.

Real Estate Tax Collectors Report: Nothing to report.

Council Committee Reports:

Building and Grounds: Ms. Kovach questioned the status of the installation of a window in a municipal center steel door. Mr. Hartswick will investigate pricing.

Mr. Hartswick stated that MARSA Contracting is re-pointing one side of the Municipal Center building.

Ms. Kovach noted the Municipal Center walking trail has been cleared of debris and should be closed for liability issues. Chief Lane suggested posting appropriate signage that the trail is closed and the entrances should be chained. Current signage will be checked for wording.

Finance: Nothing to report.

Library: Ms. O'Malley reported the library was closed Sunday due to heavy snowfall. The library director is investigating the possibility of posting library closings on the local television channel.

Planning and Codes: - The agenda package contained the November building permit report.

Public Safety: Mr. Carlucci motioned to accept the recommendation of the Mayor and Chief of Police to suspend Officer Erlich for a period of thirty days effective December 16, 2003 for his action and conduct regarding an incident which took place on November 15, 2003; Ms. Kovach seconded; all in favor; motion carried.

Chief Lane reported that the location where S. Karas requested a street light is fire department property. Chief Lane recommended placement of a street light at the intersection of the Grove Road Bridge by Willow Avenue. Duquesne Light will be contacted. Ms. Kovach questioned the changes in the animal control procedures. Chief Lane explained that on Monday-Friday from 9:00-5:00 all animal control calls from dispatch will be forwarded to Ms. McMonagle for screening. After office hours, the officer-in-charge will screen calls before dispatching animal control. This procedure should eliminate unnecessary calls and control escalating animal control costs.

Public Works: Ms. O'Malley and Mr. Carlucci commended the public works department on their excellent job of snow removal during the recent winter storm.

MRTSA: Nothing to report.

Municipal Associations:

Allegheny County Boroughs Association: Nothing to report.

Allegheny League of Municipalities: Nothing to report.

South Hills Area Council of Governments: Nothing to report.

Police Pension: Mr. Carlucci noted an increase in the November investment management statement.

Earned Income Tax Collector's Report: November distribution analysis: EIT - $50,001.28; OPT - $575.20.

Engineer Report: Mr. Hartswick presented the engineering services agreement for 2004. Mr. Cheberenchick motioned to accept the 2004 Engineering Services Agreement from Lennon, Smith, Souleret Engineering; Ms. Kovach seconded; all in favor; motion carried.

Manager's Report: Mr. Hartswick presented a service order authorization from the borough engineers to complete the 2003 Wasteload Management Report (Chapter 94 Report). Ms. O'Malley motioned to authorize the appropriate officials to execute the SOA; Mr. Cheberenchick seconded; all in favor; motion carried.

Mr. Hartswick presented the 2004 proposed budget. Mr. Carlucci motioned to adopt the Castle Shannon Borough 2004 Budget; Ms. Kovach seconded; Mr. Cheberenchick voted no; all in favor; motion carried.

Mr. Hartswick presented Tax Levy Ordinance 833 establishing the 2004 millage rate at 7.3892. Mr. Carlucci motioned to adopt Ordinance 833; Ms. Kovach seconded; Mr. Cheberenchick voted no; all in favor; motion carried.

Mayor's Report: Mayor Baumgarten attended an awards ceremony for Tim College and Paul Renz who have obtained the Eagle Scout status. The scouts will be invited to the January 12th meeting for recognition.

Allegheny County Mayor's Christmas party was cancelled due to inclement weather, and has been rescheduled for January 29th.

Mayor Baumgarten advised the meeting tonight should be adjourned sine die as the last official meeting of 2003 until the reorganization meeting January 5th.

Planning Commission: Nothing to report.

Solicitor: Nothing to report.

Keystone Oaks: Nothing to report.

Zoning Hearing Board: Nothing to report.

Other Business: Ms. O'Malley questioned the installation of a PAT light at the bottom of Baldwin Street. Chief Lane answered PAT's engineers are checking into the installation.

Mr. Carlucci asked about House Bill 1018. Chief Lane answered it relates to cellular phones.

Ms. Kovach asked the status of the sewer line emergency repair on Newport Drive. Mr. Hartswick, J. Stanton and P Coffey established a conference call this week. Mr. Stanton deemed the pipe a non-emergency repair and recommended the repair be included a future sewer pipe project. Root removal was completed.

Mr. Cheberenchick had concerns regarding the Municipal Center pointing in cold weather. Chief Lane stated MARSA is using portland cement. Mr. Ross added that MARSA will guarantee their work.
